    Washington - - At its open meeting today, the Federal Election Commission unanimously approved an advisory opinion and an Audit Division Recommendation Memorandum.

    Advisory Opinion 2022-02 (Steube) The Commission approved Advisory Opinion 2022-02 in response to a request from Rep. W. Gregory Steube and Steube for Congress, concluding that the proposed use of campaign funds for the purchase and installation of a locking steel security gate as part of the residential security system as specifically recommended by the requestor’s county sheriff’s office, and more generally by the Office of the House Sergeant at Arms, is permissible under the Federal Election Campaign Act of 1971, as amended (the Act,) and Commission regulations.

    REG 2012-01 (Electioneering Communications Reporting) - Draft Notice of Disposition Prior to the meeting, on March 21, the Commission approved by tally vote the Notice of Disposition of a Petition for Rulemaking by the Center for Individual Freedom. The Commission decided not to initiate a rulemaking in response to the petition, which asked that the Commission revise two regulations on the reporting of electioneering communications, because the regulatory changes sought have already been implemented in a separate rulemaking. Mr. Kitcher, whose appointment becomes effective July 18, oversees the Enforcement Division, which is the largest division of the Office of General Counsel. The 45-person Enforcement Division recommends to the Commission appropriate action to take with respect to administrative complaints and apparent violations of the Federal Election Campaign Act of 1971, as amended (the Act), investigates alleged violations, and negotiates conciliation agreements. FEC (Case No. 19-908), denying the Commission’s motion for summary judgment and granting the Plaintiffs’ motion for summary judgment.

    On April 1, 2019, Ted Cruz for Senate and Senator Cruz filed suit against the Commission alleging that the limit on repayment of candidate loans at 52 U.S.C. § 30116(j) violates the First Amendment to the Constitution. The three-judge panel concurred.

FEC (Case 14-00148), granting the Commission’s and Intervenor-Defendant’s Motion for Summary Judgment and denying Plaintiffs’ Motion for Summary Judgment. The lawsuit, filed on January 31, 2014, challenged the Commission’s dismissal of the Plaintiffs’ administrative complaint against Crossroads Grassroots Political Strategies (MUR 6396). The complaint had alleged that Crossroads GPS violated the Federal Election Campaign Act of 1971, as amended (the Act), by not registering and reporting as a political committee.     Washington - - The United States District Court for the Southern District of Florida issued an Order in FEC v. Rivera (Case No. 17-22643) on Tuesday, granting the Commission’s Motion for Summary Judgment.

    In 2017, the Commission brought suit against David Rivera, a former member of Congress from Florida’s 25th Congressional District, alleging that he had knowingly and willfully made contributions in the name of another in connection with the 2012 primary election campaign of another candidate in the state’s 26th Congressional District. The Commission sought a civil penalty of $456,000, which the district court granted.

The Bipartisan Campaign Reform Act of 2002 (BCRA) included provisions that indexed some contribution limits for inflation.
